Other Options to Consider:
If the parent feels the IEP process is unfair, and the school is refusing to provide what the student is entitled, the parent may request a “DESE Facilitated IEP” (DFIEP). The Missouri Department of Elementary and Secondary Education (DESE) will appoint a neutral 3rd party moderator to attend the meeting, and the results are reported to DESE. This is a free service and the form to request it is on the DESE website, found below.
A last resort would be to request what's called a “Mediation Hearing.” DESE appoints a mediator to preside over the meeting. Both sides present their issues and positions, negotiations take place, and the outcome is legally binding. This is also free, and the form to request it is on the DESE website, found below.
